论社区矫正制度的建立和完善

从国际社会的发展趋势来看,刑罚制度已经从以监禁刑为主的阶段进入了以非监禁刑为主的阶段。在许多国家中,适用社区矫正的人数大大超过监禁人数,并取得了良好的社会效果。从我国现行的刑罚制度来看,社区矫正制度刚开始建立,与国外的社区矫正制度相比,在适用的对象、范围、矫正的方法及其效果等方面都有待完善,特别是社区矫正尚未能在全国各地全面有效推行。因此,需要对社区矫正制度从理论和实践诸方面做进一步的研究和完善。

Viewed from the developing tendency of international community, the system of criminal penalty has stepped into the non- durance penalty dominated stage. In many countries, community correction enjoys popularity by overwhelming majority and has had satisfying social effects. In Chinese existing penalty system, community penalty has just started and there are many aspects to be improved and hasn＇ t been widely applied. Therefore, it＇ s necessary to further the study and improvement of this system, both theoretically and practically.
