On the Effect of International Mandatory Standard in Modern International Law

国际强行规范是国际法中近几十年内发展出来的新兴理论,其目的在于重构国际法律规范体系,限制国家意志。尽管其有诸多缺陷,但其在现实国际法律体系中占有重要的地位,如何使其发挥应有的作用是国际法学者重要的研究课题。

The international mandatory standard is the rising theory which the international law coming into being in within almost several periods. The purpose is to restructure the international legal standard system, and restrict will of stale. Despite of a lot of defects, it holds the important position in real international legal system, how to make it bring the due effect into play is important study task for the international law scholars.
