摘要
在社会转型的过程中,农村社会也经历着观念变迁和结构变动。分析农村社会秩序规范的变迁可以发现:农村的法制进程实质上受到了农村社会系统分化程度的制约,因此,农村法制建设的根本问题不在于"国家法"和"习惯法"的二元对立,而在于如何促进农村社会系统的分化与重新整合,使国家法秩序代替农村传统的规范秩序,最终成为农村社会系统的结构性要素。
In the process of social transformation, the structure of the rural community is undergoing a radical change and evolution. Exploring the adjustment of normative order in rural area, the author holds that the legal system construction in the rural community is restricted by the degree of system differentiation. Then, the root of the legal system construction in rural area is not the dual opposites between the ＂state law＂ and the ＂folk law＂, but how to promote the system of rural social differentiation and re-integration, or rather, how to make the ＂state law＂ be the element of rural system, as well as instead of the traditional rural pattern of domination.
