The Positive Jurisprudence of Freer Trade and Human Right Measures

以《关税与贸易总协定》为支柱的多边贸易体制追求自由贸易,希望以贸易壁垒的削减或取消为手段,推动全球贸易的增长。自由贸易属于国际贸易法上的价值理念,是以贸易流动不被扭曲为目标的。在追寻贸易利益最大化的同时,人类生命健康、社会公共道德,很有可能被置于受漠视的地位。人类尊严、生命价值属于国际人权法上的概念。在自由贸易与人权价值发生冲突时,需要对两者进行合理调适。

As one pillar of multilateral trading system , the GATT has set freer trade as its ultimate goal for elimination or removing of barriers to trade so as to promote the trade growth. Freer trade, which is the idea in international trade law, pursues non-distortive trade movement. While chasing for the maxim trade interests, human life and public moralities probably will be neglected totally. Human dignity, life are both something valuable in international human fight law. When these values conflict ,the coordination between them may be necessary.
