捕诉环节贯彻宽严相济刑事政策存在的问题及对策

The Problems and Countermeasures on Carring out the Criminal Policy of Combining Punishment with Leniency in Qrrest and Action

当下,实施宽严相济刑事司法政策,构建和谐社会,正在成为我国具有广泛社会认同感的共同目标。但是,由于我们在执法理念、法律规定、队伍素质等方面存在诸多问题,致使检察机关捕诉环节在贯彻该政策过程中并未很好体现该政策的精神,制约着该政策的实施。我们应当通过树立现代执法理念、坚持严打方针不动摇、完善相关的配套制度和措施等举措来确保该政策的有效贯彻。

At present, earring out the criminal policy of combining punishment with leniency and constructing harmonious society are our goal. But, there exit some problems about law enforcement concept, legal provisions and personnel quality. We should set morden law enforcement concept, insist on ＂ strike-hard＂ policy, improve related systems and measures.
