摘要
思想与表达二分法是著作权制度的理论基石。然而,具体如何划分思想与表达之间的界限是一个无论在理论界还是实务界都难以解决的问题。根据符号学理论对作品中思想与表达之间的关系进行分析表明,作品的符号性决定了思想与表达不可分,作品是思想与表达结合的整体。对作品关注的焦点应该从思想与表达之间的区别转变为思想与表达之间的联系。对思想与表达之间关系的不同认知将导致对于作品本质和价值的不同看法。
The idea/expression dichotomy is the basic pr/nciple of copyright law. However,how to make a distinction between idea and expression is a difficult problem in research or in practice. The semiotic analysis of the relationship between idea and expression indicates that idea and expression can not be separated at all. The focus on works should shift from the distinction between idea and expression to the connection between them. The different epistemology about the nature and value of works is based upon different knowledge of the connection between idea and expression.
