摘要在欧共体生物技术产品案中,专家组适用《SPS协定》调整生物技术产品问题。专家组没有从措施目的定义SPS措施,而是按照《SPS协定》文本,宽泛解释了若干措辞的含义,认定欧共体中止批准生物技术产品不构成SPS措施,但构成了不适当的迟延。专家组的裁决使得转基因作物对环境的影响纳入了协定调整范围,内国环境法规可能受《SPS协定》调整,导致了贸易与环境法规的碎片化。我国应推广转基因技术,放松对转基因食品的监管。
