摘要
现代社会是一个风险社会,侵权现象大量出现,危及社会的安定与和谐。和谐社会应是各方主体的合法权益被尊重和保障的社会。构建社会主义和谐社会离不开侵权责任法规范的调整。侵权责任法的出台是构建和谐社会的必然要求。侵权责任法的价值取向是公正与安全。侵权责任法在构建和谐社会中的价值与功能,一是和谐价值与衡平功能,二是矫正正义与分配正义。
Modern society is a risky society. Tort phenomenon appears in quantity and endangers the social stability and harmony. Harmonious society ought to be the society of legitimate interests of each main part ensured. Building socialism harmonious society has to have the adjustment of tort liability act. The implement of tort liability act is certain to require building harmonious society. Value orientation of tort liability act is fair and safety. Value and function of tort liability in building harmonious society is firstly harmonious value and balance function and secondly rectifying justice and assigning justice.
