摘要
对劳权进行权利论、伦理学的研究,已经形成了较为自足自洽的理论体系。但权利论在经济、政治、法律生活彻底世俗化的时代,难以对社会政策与制度安排产生足够的影响力。确立功能论、机制论等视角和进路,可在经验理性与逻辑理性层面,可清晰彻底地论证劳权对分配正义、内需提升、经济安全、社会和谐的功能,且劳权相关的制度和机制具有不可替代性。劳权不仅是发展的价值、道德,更是发展的必要手段和必经路径。确立多维度解释框架,利于决策者和公众形成理论确信和意识形态。
To research on labor rights in the perspective of the theory of fights and of ethics has formed a self - contained and self - consistent theoretical system. However, in the era of complete secularization of economic, political and legal life, the theory of rights is unlikely to generate sufficient influence on social policies and institutional arrangement. In the perspective of the theory of functions and the theory of mechanism, we can completely and clearly demonstrate the functions of labor rights, such as the functions of distribution justice, domestic demand promotion, economic security and harmonious society in the level of experience reason and of logic reason. In addition, the systems and mechanisms related to labor fights are irreplaceable. Labor rights are not only the value and ethics of development, they are necessary means and inevitable paths of development. To set up an interpreting frame with multi - aspects is helpful to policy - maker and the public to be convinced of theory and ideology.
