规制效率、反垄断法与行政垄断行业改革

Regulation Efficiency,Anti-Monopoly Law and Reform of Administrative Monopoly Industries

行政垄断行业,大多是国有经济占控制地位的关系国民经济命脉和国家安全的行业,《反垄断法》对合法经营予以保护,因而对行业行政垄断表现形式的研究特别重要。行业行政垄断有三种一般的表现形式——政府部门不适当的行政进入壁垒、规制机构低效率的规制行为、行政垄断企业滥用其市场支配地位的垄断行为;通过实证以及调查研究发现,后两者是当前行业行政垄断的主要表现形式,为此给出行业行政垄断改革的相关建议。

Administrative monopoly industries,mostly are state-owned and have a great impact on national economy and national security, whose legitimate business are protected by anti-monopoly law, which makes the research about the performance of industrial administrative monopoly very important. Industrial administrative monopoly has three general forms-inappropriate administrative barriers to entry of government,the low efficiency of regulation act and administrative monopoly enterprises abusing their dominant market position. Empirical test and investigation show that the latter two are the main forms for the present. In the end, three policy recommendations to the reform of industrial administrative monopoly are offered in the paper.
