“恶意欠薪”行为入罪之合理性探讨

近几年,拖欠工资现象比较普遍,而拖欠民工工资问题尤为突出,已经演变成严重、复杂的社会问题。在我国,"恶意欠薪"行为缺少刑法保护。解开"恶意欠薪"这一死结,让所有的劳动者不再受其困扰,就必须在刑法中设立"恶意欠薪罪"。这不仅体现法律的公平原则,而且完全符合刑法的立法精神。
