摘要
土地征收侵权表现为超出"公共利益"范畴,未遵循"法定程序",未给予"合理补偿"以及"复合"型侵权四种类型。政府盲目追求政绩,滥用土地征收权,批租现象严重,以地生财等职能错位是造成土地征收侵权这一后果的重要原因。因此,政府只有转变职能,做好"地"和"人"的工作,既珍惜土地资源,又坚持以人为本,才能避免土地征收侵权现象的出现。
Tortuous expropriation of land lies in four categories：non-public-interest,no due process,no just compensation and compound tortuous expropriation of land;In pursuit of achievement in one＇s post,by abusing expropriation power and authorization power of land,focus on making money by selling land,government activities Often lead to tortuous expropriation of land;only if the govern- ment transforms it＇s function,attaches great importance to ＂land＂ and ＂people＂,cherish valuable resource of land and stick to the principle of humanism,can tortuous expropriation of land be prevented.
