随着我国体育事业的不断进步与发展,体育纠纷也愈来愈多、愈来愈复杂,因此,建立健全体育纠纷的多元解决机制是非常必要的。因为良好的秩序是和谐社会的基本标志,法律是维持社会秩序的重要手段。法律的功能和使命就是通过有效地防止、解决纠纷来形成和维持秩序。对和谐的推崇也表明社会力求通过平和的方式和手段,既包括必要的妥协、宽容和谦让也包括理性的是非判断和利益平衡,争取使纠纷各方达到和谐、互利和共赢。

As the founder of the first socialist state in the world ,the judicial thoughts which Lenin elaborated had influenced the construction of the judicial system in the whole camp of socialist states.Thought the former Soviet Russia that Lenin founded had been disintegrated,however the camp of socialist states has been existing.At present,we look back again the judicial thoughts of Lenin to appraise and to understand rightly the conception of Lenin to the judicial system of socialist states,and draw lesson from Lenin＇s conception about the judicial system of socialist states to serve the practice and perfection of the judicial system of our socialist state .which have some significance of the times and some theoretical value.
