加强动物保护立法的思考——兼评动物的主体地位

动物不能成为人类道德的主体,动物成为人类法律关系的主体也存在诸多障碍。在人类生存环境日益恶化的今天,为了维护生态平衡,对动物加强立法保护非常必要。我国在动物保护立法方面虽取得了一定成效,但仍然存在着不足。针对我国动物保护立法存在的问题,我们必须做如下努力:第一,明确动物保护立法的原则;第二,修改《野生动物保护法》和其他部门法中有关动物保护的规定;第三,制定《中华人民共和国动物保护基本法》及其他配套法规。

Animals can not be the subject of human morality. There are also some obstacles for animals to become the subject of the legal relationship of human beings. Nowadays, the environment is becoming increasingly deteriorating. In order to maintain ecological balance, it is necessary to strengthen the legislative protection of animals. Although great progress has been made in animal protection legislation in China, there is still some insufficiency. In view of the existing situation, some efforts should be made：First, to clarify the principles of animal protection legislation; Second, to amend ＂Law on the Protection of Wildlife＂ and other laws relating to the protection of animals;Third, to formulate and enact ＂Law of the People＇s Republic of China on the Protection of Animals＂ and other regulations.
