片面共同犯罪是客观存在的一种犯罪现象。各个学者的共同犯罪理论基础不同,对片面共犯是否是共同犯罪有着不同的结论。其实,片面共犯由于犯罪人之间缺少意思联络这一共同犯罪的要件,不是共同犯罪;对构成犯罪的应按独立犯罪处理。片面共犯虽然不是共同犯罪,但并不妨碍我们借鉴共同犯罪关于犯罪人的分类来分析片面共犯的存在形态。而片面共犯并不是在任何情况下都存在的,只有片面实行犯和片面帮助犯两种存在形态。

One-sided accomplice as a normal criminal phenomenon is interpreted by scholars to be either a joint crime or not,depended on their respective theoretical basis.This paper argues against that it is a joint crime,for the reason that it lacks the requisite fact that the persons involved have intention liaison among them,therefore,the offenders shall have independent conviction.Although one-sided accomplice isn't attributed to a joint crime,they have the same existing forms,which include one-sided implementation crime and one-side accessory crime.
