海南省海洋管辖权若干问题刍议

On the Marine Administrative Power of Hainan Province

海南省是全国惟一一个拥有海洋管辖权的省份,但实践中却由于法律规定不明确而长期搁置,没有得到充分发挥。海洋管辖权应该依事权与财权对应、责权利统一的原则,包括海洋油气资源与渔业资源的管理与海洋生态环境的保护,应以立法形式明确海洋管辖权的内容,以推动我国海洋事业加速发展。

Hainan province is the only province which has marine administrative power, but this power has long been practically ignored because of fuzzy legislation. This power should follow the principles such like the parallelism of affair right and wealth control, the combination of responsibilities, power and interest; this power should include the management of ocean oil and gas resource, and fishery resources, and the protection of marine ecological environmental system as well. To effectively promote the development of China＇ s marine affairs, the content of marine administrative power should be defined in legislative form.
