特有范畴的形成及其体系的构建,是中国宪法学走向成熟的必经之路,也是中国宪法学者的共同学术使命。马克思主义哲学的范畴理论对于中国宪法学范畴体系的构建具有重要的指导意义。中国宪法学范畴的形成及范畴体系的构建应当遵循下列原则与方法:逻辑和历史相统一的原则;从具体现象分析、归纳到抽象本质综合、演绎的辩证理性概括方法。宪法秩序这一概念的自身属性符合中国宪法学范畴的构建原则和方法,应当成为中国宪法学的范畴之一。宪法秩序作为中国宪法学的范畴,具有重大的理论价值和实践意义。

The formation of unique category and its system is the specialized need of Chinese Constitution, the only way to maturity of Chinese Constitution, and also the common academic mission of scholars of Chinese Constitution. Category theory of Marxist philosophy has important guiding significance on the formation of Chinese Constitution category. The formation of Chinese Constitution category should observe the following way： the unity of logic and history ; from the analysis and summarize on specific phenomenon to Comprehensive and dialectical rational interpretation on abstract nature. The attributes of Constitution order concept in line with the formation principles and methods of Chinese Constitution category should become one of Chinese Constitution category. Constitution order as a Chinese Constitution category has great theoretical value and practical significance.
