论新中国法和法学的起步——以“废除国民党六法全书”与“司法改革运动”为线索

新中国建立前后出现的"废除国民党六法全书"与"司法改革运动"两大历史事件,对当时中国法和法学的起步造成了巨大而深远的影响。当我们庆祝新中国延生60周年之际,对这两大事件的发生、发展、时代背景和社会原因,以及其与新中国法和法学发展的内在关系进行追溯、分析和反思,对我们更加自觉、更加稳健地建设新时期的中国社会主义法和法学具有重要的历史和现实意义。

Before and after the emergence of New China, the two major historical events of ＂the abolition of the KMT＇s Six Guidebook＂ and ＂Judicial Reform Movement＂ have had a great start and far- reaching impact on the beginning of Chinese law and jurisprudence. When we celebrate the 60th anniversary of the birth of new China, the occurrence of these two, development, historical background and social causes, as well as its with the new Chinese law and legal development of the intrinsic relationship between the retrospective, analysis and reflection, more conscious of our more sound to build the new era of China＇s socialist law and jurisprudence has an important historical and realistic significance.
