计算机取证及应注意的原则探讨

多数情况下,为法庭起诉等目的而收集作案证据是比较困难的,如果是面向计算机取证,取证工作面临的情况就更复杂。因为计算机里面的电子证据没有传统证据所具有的那些永久不变的特征,更难以用易于理解的形式在法庭展示。本文结合计算机证据取证实践,概括了计算机取证面临的挑战,并提出了克服困难的一些建议策略。必须说明的是,本文并没有包罗在任何情况下都可能有用的所有内容,仅仅是某方面的参考。对一些特殊情况,还请参考更多的资料。

At an overwhelming majority time, it is very difficult to obtaining evidence for the use of submitting a ease to the court, if obtaining from computer it will be more difficult. Because all of the electronic evidences from the computer are different from any ev- idence get from the normal procedure,all of the evidences get from computer are very easy to change and are difficult to show to peoples in some form not difficult to understand. This paper discussed some challenge when obtain evidence from computer and some things to deal with the situation. All discuss get from the practice of obtaining evidence from computer.
