试论《反分裂国家法》与军事法的关系

On the Relationship Between the "Anti-Secession Law" and Military Law

《反分裂国家法》的出台是维护台湾海峡地区的和平稳定,维护国家主权和领土完整,维护中华民族的根本利益的重要举措。《反分裂国家法》是宪法性法律,其中第8条是军事法的重要渊源。因此,该法与军事法是交叉关系,但基于目前情况应当将其纳入到军事法范畴进行研究。

＂Anti-Secession Law＂ is to safeguard peace and stability of Taiwan Strait, safeguarding national sovereignty and territorial integrity, and safeguarding the fundamental interests of the Chinese nation. ＂Anti-Secession Law＂ is a constitutional law, article 8 of ＂Anti-Secession Law＂ is important source of military law. Therefore, the law and military law are cross-relations, but based on the current situation, ＂Anti-Secession Law＂ should be incorporated into military law areas.
