村民委员会的法律地位探析

现行法律对村民委员会的定位不准,尤其是没有理顺村民委员会与村民会议以及它与农村集体经济组织的关系,故有必要对村民委员会的地位进行探析。建议完善相关法律,对村民委员会进行重新定位。重点从以下几个方面来进行:明确界定村民委员会的性质;确立农村集体经济组织的法人地位;参照公司法人治理结构模式来确定村民委员会、村民会议、农村集体经济组织三者之间的关系。
