建立我国ADR补偿救济制度的探讨与思考

Discussion and Consideration about the ADR Compensation System in China

到目前为止,我国药品不良反应(ADR)所致伤害责任主体缺失,无法可依,导致"索赔无门"。患者往往独自承担药品不良反应伤害后果,造成不良的社会影响,因此,亟待建立相应的风险分担机制。在参考了海外药品不良反应补偿救济制度的基础上,对我国建立药品不良反应伤害补偿救济制度进行探讨和分析,并提出一些具体的思考和建议。

Because lack of the responsibility body, the law about compensation of adverse drug reactions in China, the sufferers can not get any compensation from the correlative responsibility party, lead to the sufferers take on the injured result, give some bad lesson to the society. Therefore, the country should study the risk-shared system of ADR. The author gives some suggestions to how to set up ADR compensation system based on reference to the other countries＇ experience.
