论我国刑法中死刑限制的途径

On The Way of the Death Penalty Limits in Our Criminal Law

死刑的存、废问题,在世界范围内争议较大。我国现阶段仍然保留死刑,并是执行死刑最多的国家。有学者认为废除死刑是历史的必然趋势,提出应当废除死刑。本文从国际和我国的现状出发,提出在我国目前所处的社会历史条件下并不具备废除死刑的根基,我们要做的是如何在我国现有刑法制度的范围内,通过立法和司法限制,大幅度减少死刑的适用。

The problem of death penalty existence or abolishment disputes in worldwide. The death penalty is still retained in our country and carries out the most in the world. Some scholars proposed to abolish the death penalty because they thought it was the historical inevitable trend. This article thinks that there is no foundation for our country to abolish the death penalty now. What we are going to do is reducing the implement of death penalty on a large scale through the legislation and the judicial limit under our criminal law system.
