摘要
《劳动合同法》的颁布使得竞业限制制度对商业秘密的保护有了明确的法律规定。运用比较分析的方法,介绍商业秘密保护中的法定竞业限制制度和约定竞业限制制度,比较两者对于商业秘密保护的不同,并立足于对商业秘密的完整保护,对法定竞业限制制度和约定竞业限制制度的完善提出建议,以更好地保护中国的商业秘密。
With the publication of the Labor Contract Law, it has a clearly legal rules to protect the commercial secrets through the prohibition of business strife. Using the method of comparative analysis, the paper introduced the legal prohibition of business strife and the agreed prohibition of business strife to protect the commercial secrets. Comparing the diversity between the legal prohibition of business strife and the agreed prohibition of business strife, standing on the entire protection of the commercial secrets, the paper gave some advices to perfect this two sys- tems to provide much better protection for the commercial secrets.
