What Kind of International Rule of Law We Can Expect

构建国际法治的现实基础是一个以主权国家为成员的"无政府"的国际社会。在此基础上构建的国际法治只能是"国际法之治"。国际法治的基本目标应该是建设一个更有秩序、更有效率和更加公平的国际社会。鉴于缺少中央权威的立法将是一个相对缓慢的过程,而秩序、效率和公平的内涵也都是发展变化的,因此,国际法治的构建将是一个渐进的过程。

The realistic basis of building up international rule of law is that a 'non-governmental' international society takes the sovereign nations as members,which actually is 'rule of international law'. The basic goal of international rule of law should be to construct a more orderly,more effective and more equal international society,which will be a gradually process since the legislation without the central authorities will be a slowly process,whereas the connotations of order,efficiency and equality are changing and developing.
