期待可能性的成立要件探究

On the Essential Ingredients of Anticipated Probability

任何事物都有其特定的构成要素以及要素的构架,期待可能性也不例外,目前在刑法学界几乎还没有引起学者对期待可能性成立要件应有的重视。在正确厘清期待可能性内涵及其本质的基础上,期待可能性的构成应当具备以下两个条件:技术性要件与价值性要件,前者指异常性客观情状以及控制状况的受抑制性,后者指刑法上的可谅解性。通过对期待可能性内部结构的探究,以期从根本上寻求一条解决期待可能性惨遭滥用之危险问题的有效途径。

Everything owns its specific ingredients as well as its structural frame, and anticipated probability is no exception. For the time being, due attention hasn＇t been paid to the essential ingredients of anticipated probability in the field of criminal law theory. Upon correct understanding of the connotation and the essence of anticipated probability, the structure of anticipated probability should be composed of the following two ingredients： technical ingredients and ingredients of value. The former refers to the abnormal objective circumstances and the suppression of the capability of control, while the latter refers to the extenuating and mitigating circumstances in criminal law. Through the research on the inner structure of anticipated probability, a reliable way of fundamentally resolving the danger of abusing anticipated probability is expected to be found.
