中国法律史教材的体例、内容及其重构

On the Style, Content and Reconstruction of Chinese Legal History Textbooks

中国法律史是高等学校法学专业的基础课程,它承担着传承传统法律文化、培养具有深厚传统法律文化素养的法律人才的重要任务。目前,该课程的教材体例、内容尚不能完全满足文化传承、人才培养的要求,存在不少问题。突出表现在:制度史与思想史分开设置,人为切断了二者的有机联系;课程以断代体例编排,体系杂乱;教材内容陈旧等等。其重构方案是:将制度史与思想史合并为一门课程;取总论与分论的编排体例;更新内容,将新中国法律制度、法律思想融入其中;进一步消除左的阶级观的影响,将当前法制建设可资借鉴的传统法内容在教材中做充分的反映和体现。

Chinese legal history is a basic course of the law major in universities, whose task is to carry forward the traditional Chinese legal culture and cultivate legal talents with profound knowledge of traditional Chinese legal culture. However, the present teaching style and content of this course can not fully meet the requirements of passing down cultural heritage and training qualified legal talents. The existing problems are as follows： the history of legal systems is separated from the history of legal philosophies in the textbook, which artificially cuts off their organic connection; the curriculum of this course is compiled in a dynastic style, which is disorderly and unsystematic; the content of the textbook is out-dated, etc. There are several ways of recon- structing the course, for example, integrating the history of legal systems with the history of legal philosophies, adopting the compiling style of general introduction and specific explanation, updating the book with new legal developments including the legal systems and legal theories of the new China, further eliminating the impact of left-wing class concept in order to fully reflect and embody the traditional legal content which can be used for reference in the reconstruction of Chinese legal history textbooks, etc.
