摘要
面对频繁爆发的版权侵权诉讼，视频分享网站普遍无法成功利用避风港规则获得免责。法律规定不明确、配套制度不完善、人文意识未跟上、对公众利益考虑不足是避风港规则无法正常发挥作用的原因所在。
the face of the frequent outbreak of copyright infringement lawsuits, video sharing sites in general can not be successfully used to obtain safe haven exemption rules. The law is not clear, matching system is imperfect, human consciousness did not keep pace with the public interest, lack of safe harbor rules are not the reason to play a role.
