对检察机关量刑建议权的思考

On suggestion right on penal discretion of inspecting departments

本文简要介绍了西方国家量刑建议制度确立的历史时期和我国刑事政策的时代发展变化,阐述了在我国检察机关行使量刑建议权的重要价值,就量刑的实践问题提出了建议。

This paper briefly introduces historic time for establishment of the system of suggestion on penal discretion in western countries and the changes in criminal poliey development in China, expounds the important value of implementation of suggestion right on penal discretion in China＇s inspecting departments and gives suggestion on practice of penal discretion.
