试论监管立法制度的完善——以商业特许经营备案为例

On the supervision of the Legislative System——Make commercial franchise record as an example

全球金融危机的发生，使得政府监管成为各界关注的热点话题，本文以特许经营备案制度为例，指出了特许备案制度实施中所面临的问题，即特许备案的效率和效果均不理想。在借鉴国外有关立法实践和理论的基础上。提出了完善我国监管立法制度的建议：包括运用监管影响分析、提高监管透明度、运用监管替代措施等。

The occurrence of the global financial crisis, making government regulation has become a hot topic of concern from all walks of life. In this paper,a franchise record system as an example,pointing out that the implementation of the concession filing system problems,namely the efficiency and effectiveness of the record is not ideal.Foreign-related legislation in practice and theory on the basis of the proposed regulation to improve the legislative systetn in China a number of recommendations： including the use of regulatory impact analysis,to improve regulatory transparency ,the use of alternative regulatory measures.
