摘要
我国的食品安全标准体系在《食品安全法》颁行后有所变化,即食品安全标准皆为强制性标准,包括食品安全国家标准、食品安全地方标准和食品安全企业标准三类。从规范法学角度看,食品安全标准的强制性是指食品安全标准"具有强制效力",而非食品安全标准本身是强制标准。在食品安全标准整合和衔接的过程中,应采取"合理解释和区别实施"的原则,力图实现食品安全法律规制的连续性和统一性。
China's food safety standards system has some changes after the "Food Safety Law" enacted,that is,food safety standards become all mandatory standards,including national standards,local standards and enterprise standards of food safety.From the normative law point of view,mandatory of food safety standards means it has the effectiveness of mandatory,rather than it is the mandatory standard itself.In the process of food safety standards" integration and convergence,we should adopt the principle of reasonable explanation and distinction implementation,which seeks to achieve continuity and uniformity of food safety regulatory system.
