摘要
《物权法》第106条规定了不动产善意取得制度,这无疑是非常正确的。但这一以牺牲不动产静的安全(所有权安全)来维护动的安全(交易安全)的制度只有正确适用才能发挥其应有的作用,毕竟不动产对原所有权人和善意买受人都意义重大。因此不动产善意取得制度的如何正确适用成为当前最关键、最亟待解决的问题,在适用不动产善意取得制度时,应分清其适用范围,明确善意的标准,充分保护原权利人的利益,并抓紧建立由人民法院作为登记机构的不动产统一登记制度。
The No.106 of The real estate lawstipulate the real estate's bona tides acquirion system.Obviously,It's correct.But this good system sacrifice the ownership's static secure to defend the trade secure,you can see the system is very immportant to both sides,so only when it's be used correctlly can play it's full use .Now the key question is how to use it correctlly,we must discern the scope of application,clear and definite the standerd of good faith,fully protect the benefit of both sides,at the same time,we must bulid the new system to let the people's court be the egistration office of the real property.
