机动车转让与车险保单效力延续的法律思考

机动车使用所产生的风险损失属于一种社会成本,从保护受害人的公共利益出发,应规定机动车转让与机动车强制保险转移同时进行而无需征得保险人的同意,强制险保单变更手续的完成应作为机动车办理过户登记的前提要件。机动车商业性保险,以机动车保险利益转移时间作为判断受让人受保险合同保障的时间点。保险合同效力是否延续,取决于保险车辆转让是否显著增加承保风险发生的可能性或影响保险人收取保险费的权利。投保人或受让人应及时通知保险人保险车辆变动的情况,保险人认为有合理的理由解除保险合同的应当在接到变动通知时及时明确提出,否则将丧失在保险事故发生后拒绝支付保险赔偿金的抗辩权利。

The risk loss of using motor vehicles is a kind of social cost.For the sake of public benefits of victirris,regulations should be made on the simultaneous execution in transferring motor vehicles and the motor vehicle liability compulsory insurances without the consent of insurers,and on the ownership transfer registration,of which the premise condition should be the modification of motor vehicle liability compulsory insurance policy.Motor vehicle commercial insurance judges the time when insurable interests of motor vehicles have been transferred as the point when benefits of transferees are guaranteed.Whether the effect of insurance contracts is continued depends on whether the transference of motor vehicles might significantly increase risks undertaken or affect insurers＇ right of charging insurance premiums.The insured party or transferee should inform the insurer in time of the changes in insured vehicles.If the insurer has reasonable grounds to consider rescission of the insurance contract,he/she must make a timely and clear presentation upon receipt of notice of changes,or else he/she will lose the right of defense of refusing to pay insurance compensation after insurance accident.
