摘要
分析了小区地下车库的地下空间使用权,认为国家应确定地下空间利用权,保障业主住宅功能最大化实现。小区地下车库的建造需要以取得地下空间利用权为前提,进而才能成为合法物的所有权客体。国家应加强对小区地下车库价格的干预,避免车库资源浪费。
The underground space right of underground garage in housing estate was analyzed. Country should determine the underground space right to protect residential property owners to maximize the functional implementation. Community required the construction of underground garage in order to obtain the use of underground space in the right premise, which can become the object of legal ownership of objects. Country should strengthen community interventions on the price of underground garage to avoid resource waste.
