贵州省“新型农村合作医疗”制度运行中的问题及对策

The Purpose of Legislation in China Environmental Protection Law and Its Modification——Towards the basic law on the protection of environment and natural resources

"新型农村合作医疗"制度在贵州省已经实施了5年,本文在对全省进行抽样调查和实证研究的基础上,归纳了新农合制度运行中出现的各种问题,并提出了解决的对策和措施。

There are various theories on the modification of the legislation purpose in China Environment Protection Law, which falls mainly into three types： theories of micro modification, middle modification and the harmony between nature and mankind. Generally, there are strong points and weak points of the three respectively. Therefore, we cannot rely on one of them completely. In fact, it is possible for us to consider and solve the problem related to modification of the legislative purpose based on legislative methodology, legislative idea and legislative expression. As a result, the first article of the current environment law might be modified as follows： This law is drafted aiming to prevent environment pollution and ecological damages as well as waste in the exploitation of natural resources, to protect and improve environment to safeguard the health and property of human beings, to ensure the ecological balance and safety, and finally to achieve sustainable development of social economy and the harmony between nature and human.
