On the jurisprudential meaning and realm of normative words:Reflection based on the transformation from new analytical jurisprudence to deontic logic

通过语义分析和逻辑分析,研究规范性语词的法理意义及其在法律场域中的适当范围与边界,认为规范性语词是理解法律本质的核心范畴,即规范性语词是规范体系的逻辑根基,其特殊功能在于创设法律规范的规范性。必须注意道德场域的价值词在转换为法律场域的规范性语词的过程中,语词本身所传递的行为标准的耗损问题。

The jurisprudential meaning of normative words and its proper realm can be explained in terms of semantic analysis and logical analysis. It is concluded that normative words which are concerned with the normativity of norms would be the key to understanding the essence of norms. When the realm of legal normative words are taken into account, more attention should be paid to the fact that while the moral value - words are translated into the legal normative words, the behavioral criteria of the words is changing in the process.
