论我国黑社会性质组织犯罪的立法完善

随着我国经济和社会的发展,黑社会性质组织犯罪不断增多,在各种"严打"整治斗争中,都将这类犯罪作为严厉打击的重点对象之一。但是,在司法实践中依法准确地打击黑社会性质组织犯罪面临着诸多难题,表现在立法上:罪名设计缺乏前瞻性和完备性;包庇纵容黑社会性质组织罪刑罚设置轻;缺乏对财产刑的规定。因此,要依法打击和预防黑社会性质的组织犯罪,首要任务就是要完善法律,提高黑社会性质犯罪的量刑幅度,增设财产刑。
