Model and Policy Analysis on the Intellectual Property Rights Based on the Value Orientation of Encouraging Innovation

知识产权制度与技术创新之间存在一种互动关系。根据累积创新的技术竞争模型,分析了创新者授权许可或不授权许可使用,追随者进行模仿、获得许可、选择退出等不同情形的社会福利函数。基于创新激励的价值取向,提出发展中国家应当构建平衡型、渐进型和区别型的知识产权政策。

There is an interactive relationship between intellectual property system and technological innovation. According to the technology competition model in cumulative innovation, the social welfare function under different situations, including the innovator with or without authorization, the follower imitating, being permitted to use or opting out, is analyzed. Based on the value orientation of encouraging innovation, the developing country is proposed to adopt balanced, progressive and differentiated type of intellectual property policy.
