作案手段、犯罪模式与“签名”特征之辨析

作案手段、犯罪模式与"签名"特征都表征犯罪进行过程中某种形式样态,其内涵与外延均有差异:作案手段是指特定人或特定犯罪团伙所选择的犯罪的途径或方法;犯罪模式是以两个以上不特定的犯罪人或犯罪团伙的作案手段为基础而整理出的一套具有共通性的作案手段;"签名"特征是犯罪者因个人人格上的特质而强迫自己实施的一种"签名"式行为。明确区分三个概念的异同,有利于解决目前侦查实践中三者使用混淆的状态,准确把握三者各自的侦查价值,为侦查破案和犯罪预防工作服务。
