行政听证制度在我国的设立已有十几年时间了,将中外行政听证制度进行横向比较研究,结合我国行政执法的实践,就可以看出我国现行行政听证制度存在某些问题,其重要的程序价值意义还没有充分展现出来,还必须进一步完善我国目前的行政听证制度,以发挥其应有的价值魅力。本文通过对行政听证制度的法理渊源和功能进行探讨和分析,从中透视听证制度的价值内涵和精神意蕴,明晰行政听证制度在实现民主行政中的意义,以进一步完善我国听证制度和推进民主法制建设的进程。

Administrative hearing system has been established in China for more than ten years. After comparing this system with different countries and integrating the judicial practice in our country, we can notice because it exists quite a few problems in our administrative hearing system and value of this system has not been developed well yet, it is essential to refine this system in our country in order to make full use of its core value. In this essay, the author perceives the value and inside meaning of administrative hearing, and clarifies the merit of this system in the process of democratic administration through reviewing and analyzing jurisprudence and function of this system.
