法国行政法官专业化培养模式及对我国的启示

Specialized Training Model of the French Administrative Judge and Its Enlightenment to China

法国存在着两个法院系统,即普通法院系统和行政法院系统。普通法院属于司法机关,而行政法院隶属于行政机关,是行政机关的一部分。但行政法院并没有丧失其独立性和司法性,由于其在行政和司法领域的高度专业性,政府官员认为行政法官在行政领域是专家。行政法官的成功得益于法国行政法官专业化培养模式。我国行政法庭的建设和行政法官的专业化培养方面还处于起步阶段,行政法官的专业化培养需要探索我国的本土化培养模式。

There are two court systems in France, that is, ordinary court system and administrative court system. Common courts are the judiciary, and administrative courts belong to the government, and are part of administrative organization. Administrative courts, however, do not lose their independence and judicial because officials believe that the administrative judge is an expert in the area of administration owing to their highly professional skills in the field of administration and jury. The success of the administrative court in France contributes to the specialized training model of the administrative judge. On the other hand, the construction of China＇s administrative courts and the specialized training of administrative judge is being at the stage of exploration. And we should try to explore a local training model of specialization of the administrative judge with Chinese characteristics.
