摘要
内部行政行为的司法救济问题在当前的理论研究上存在争议,法律规定上也有一定的模糊性,这样的状态已经影响到了行政诉讼的顺利进行和行政相对人权益的保护。本文试图从性质上对内部行政行为做一区分,将其划分为工作性质和人事性质两类不同的内部行政行为,将工作性质的内部行政行为划分为对相对人权利义务产生实际影响的行为和对相对人权利义务没有实际影响的行为,将前者纳入司法救济范围在理论上和法规上是无障可行的。
The internal administrative acts of judicial relief, with its certain legal ambiguity, are controversial in the current theoretical study. The status-quote has affected the smooth conducting of administrative proceedings and the protection of the rights and interests of the administrative counterparts. This article makes a distinction between various acts and divides them into the nature of work and personnel; divides the internal administrative acts into the relative rights and obligations of the administrative counterparts and includes the former into the limits of legal relief, which is feasible in practice.
