从自然权利、法律权利或宗教权利来建构人权内容都缺少生活性内容和民众性主体,而习惯权利与人权在本质、内容与产生方式上存在着契合的可能性。二者契合的方式是习惯权利的人权推定。它包括立法程序中的立法直接推定与习惯法法源地位的间接推定,以及司法程序的司法解释推定与司法判例推定。习惯权利的人权推定应遵循合法性、正当性、合理性、价值性与程序性原则。
