摘要
罗尔斯的契约理论作为一种理性选择模型,试图严密地推导出公平正义诸原则;然而,一些技术失误阻碍了这一目标的实现。罗尔斯不得不完全依赖康德式的先验论证和"自由而平等的人"这一规范概念。与此同时,对罗尔斯理性选择模型的修正或严密化却推导出与公平正义相迥异的正义原则。由于理性选择路径未能吻合康德式的先验路径的方向,形式上将两种路径整合在一起的契约设计不能为公平正义提供实质性的辩护。
As a rational choice model,Rawls' contract theory attempted to derive the principles of justice and fairness in a rigorous way.However,certain technical errors impeded the attainment of this goal.Rawls was unable to avoid relying on Kantian a priori argumentation and the normative concept of the 'free and equal person'.At the same time,a revision of Rawls' rational choice model that renders it more rigorous points to a different configuration of the principle of justice.Since the rational choice model is not consistent with the Kantian a priori approach,the two different formal approaches fail to provide substantive justification for the principles of justice and equity.
