法律何以能被信仰?——兼与法律信仰不可能论者商榷

How Law Can Be Believed?:Also a Discussion with the Law-Cannot-be-Believed Scholars

法律信仰是信仰者结合超验体验和理性确信、穿越精神虚拟和物质现实,强化主体意识和工具价值的一种超现实的精神活动。当代中国必须建构实在法、伦理法和自然法三位一体的法律信仰的理想图景,以解开僵化的"制度之网",弥合法律文化的断裂和混乱,进而发挥法律信仰的精神激励、文化整合、凝聚和约束功能,至此从根本上验证了为现实功利所累,站在此岸看彼岸的法律信仰不可能论者的不堪一击。

Legal belief is a kind of surreal mental activities of believers＇strengthening subject sense and instrument value by combining transcendental experience and rational convincing and passing through spiritual virtually and material reality. Contemporary China must construct the ideal picture of trinity of positive law, ethics law and natural law for legal belief, in order to untie the rigid ＂ system of network ＂,bridge the fracture and confusion of legal culture and exert legal belief＇s functions of spiritual encouragement, cultural integration, cohesion and binding. And this has verified basically the vulner- abiliy of unbelievers in legal belief who are tired out by the real utility and stand on this side to see the other.
