摘要
我国现有的行政纠纷解决机制在实践中存在着路径缺失、体系失调和机制分裂等缺陷,学界对引入"合意型"非诉讼纠纷解决方式也有着各种质疑。然而,现代行政纠纷的多样化,决定了只有多元化的行政纠纷解决机制才能满足社会主体对行政纠纷解决方式的多样性需求。为此,应当在完善现有行政纠纷解决途径的基础上,引入和解与调解等合意型纠纷解决方式,并充分重视行政纠纷在行政程序阶段中的预防和解决,由此构建一个诉讼与非诉讼相衔接的多元化行政纠纷解决机制。同时应该从微观上完善各个具体的制度设计,尤其是对行政诉讼和解与调解制度的立法设计。
There are the defects of lack of path, system disorder and mechanism breakup in the existing settlement of administrative disputes and the academic circle question the introduction of settlement of nonlitigation disputes. However, diverse modern administrative disputes determine that only a diverse settlement can meet the demands. Therefore, by improving the existing settlement of disputes, we should introduce reconciliation and mediation and focus on the prevention and settlement of disputes in the stage of administrative process so as to establish a diverse settlement of disputes to connect litigation and nonlitigation. Meanwhile, we should improve each detailed system design, esp. , legislation of reconciliation and mediation.
