新疆少数民族地区法律援助——现状调查与研究

Current Situation of Legal Aid in Xinjiang Uygur Autonomous Region

在对新疆维吾尔自治区法律援助现状调查的基础上,本文揭示了少数民族地区法律援助存在的问题,包括基层法律援助经费严重短缺、法律援助服务人员数量不足、法律援助制度知晓率低等。其主要成因是:政府法律援助责任的落实不足从根本上制约了工作的展开,少数民族地区简单经济模式、宗教信仰、风俗习惯使群众对法律援助制度的青睐缺少利益驱动,公民法律意识的淡漠亦在一定程度上减损了法律援助制度乃至整个法律制度的功能。因此,应争取政府加大财政投入并完善经费监管机制、成立特色化的"少数民族法律援助中心"等,从经济、人员、立法、监管等方面寻求解决少数民族地区法律援助问题的对策。

Based on an investigation on current situation of legal aid in Xinjiang Uygur Autonomous Region,this study examines several issues including a serious shortage of funding for legal aid at the grass-root level,the insufficient legal aid staff,and a huge majority of people who need legal aid but are not aware of its existence. Causes behind these issues are sorted out:undefined responsibilities in the government's legal aid system,a combination of simple economic model,religious beliefs,and customs in ethnic minority regions resulting in disinterest in any legal aid system,and a low level of awareness of the legal aid system which weakens the power of the system Therefore,we should strive to win an increase in government financial support in the legal aid system,establish a 'legal Aid Center for Minorities' and thus find solutions for those in the ethnic minority regions in terms of local economy,staffing,legislation and supervision.
