摘要
中国现行司法赔偿理念应是善理念、平等理念、秩序理念、公平正义与效率理念等的有机体。应努力构建权利型法律文化、限权型法律文化、程序正义型法律文化和信仰型法律文化,以推动司法赔偿制度步入良性循环的轨道。
Chinese judicial compensation idea should be an organic part including good idea, equality idea, order idea, fairness and justice and efficiency idea. Chinese judicial compensation system should try to construct new legal cultures, including fights-type legal culture, power-restriction-type legal culture, procedure-justice-type legal culture and belief-type legal culture. Thus, it can give impetus to Chinese judicial compensation system for a good turning.
