国防企业自主创新知识产权保护的法律思考

我国目前现有的国防知识产权制度在很多方面与我军现代化建设的跨越式发展需要不相适应,亟待改革。知识产权制度有助于激励自主创新、有利于配置创新资源、为自主创新提供法律保护。国防企业自主创新知识产权保护存在法律意识淡薄、法律体系不完备、管理体系不完善、人才建设僵化等突出问题。应全面提高国防科技知识产权保护意识,大力加强国防科技知识产权法规建设,尽快完善国防科技知识产权管理体系,高度重视国防科技知识产权人才培养,充分发挥行业协会和中介服务机构的作用。

Our country present existing national defense intellectual property system already is not to adapt the needed in many aspects with our army modernization＇s leap frog development. The intellectual property system is helpful to drive the independent innovation, is advantageous to the disposition innovation resources, provides the legal protection for the independent innovation. The national defense enterprise independent innovation intellectual property protection is light of legal awareness, the incomplete legal framework, the imperfect management system, the rigid of the talented person construction and so on. It is necessary to raise the defense-related science and technology intellectual property protection consciousness comprehensively, strengthen the defense- related science and technology intellectual property rights laws and regulations construction vigorously, consummate the defense-related science and technology intellectual property rights management system as soon as pos- sible, take the defense- related science and technology intellectual property rights personnel training, display the profession association and intermediate services organization＇s function fully.
