关于医疗损害赔偿中精神损害赔偿的研究——试论日本民法与美国医疗损害赔偿制度的借鉴意义

Studying on the Compensation for Mental Damage in Medical Dispute from the Reference of Japanese Corpus of Civil Law and Rules of Medical Injury Compensation of America.

相对于发展较为成熟的日本民法典与美国医疗损害赔偿制度,我国的医疗损害赔偿制度还在不断探索与改革中,尚未建立完善的精神损害赔偿制度,而医疗损害赔偿中索要精神损害赔偿的案件正在日益增多,制度上的欠缺已经带来了很多弊端。文章希望通过分析日本与美国法律中的相关规定,为改善我国医疗损害赔偿中的精神损害赔偿提供借鉴。

Compared to the Japanese Corpus of Civil Law and the Rules of Medical Injury Compensation of America, the rules of medical injury compensation of China is not consummate, especially rules of mental damage compensation in medical dispute. There have increasing medical cases appealing for mental damage compensation recently, but the rules＇ defectiveness has influenced on them. Provisions of the Japanese Corpus of Civil Law and the Rules of Medical Injury Compensation of America was analyzed to provide reference for developing the rules in China.
